The protection of your personal data is a major priority for us, the Silgan Group, managed by Silgan Holdings Austria GmbH, and our subsidiaries (summarily referred to as “SILGAN”).. Personal data (e.g. a data subject’s name, address, phone number and email address) are always processed in accordance with the general Data Protection Regulation (GDPR) and the data protection regulations of the relevant country, such as the Austrian Data Protection Act (DSG) and the Austrian Telecommunications Act (TKG).

GDPR places us under an obligation to protect your data. It is a duty which we take very seriously, and we expect our business partners to have the same attitude.

  1. Which data do we process?

The personal data we process are those we receive from you as part of our business relationship with you, or data which you voluntarily share with us. All these data are business-related in character, have their origins in business and are processed under the principle of data minimisation (GDPR Article 5 (1) point c).

The data categories we process are not “special categories” as defined in GDPR Article 9. Moreover, we do not collect or process personal data automatically (GDPR Article 21), and neither do we apply profiling (GDPR Article 22).

  1. Purpose of data processing

As part of our business relationship we process personal data for the following purposes:

2.1 To communicate with the business partner on products, services, projects, enquiries, etc.

2.2 To prepare, handle and manage business relationships and to maintain business relations between Silgan Metal Packaging and its business partners (e.g. for purchase orders, delivery of products/services, handling payments and payment requests as well as for accounting, etc.)

2.3 To provide promotional material

2.4. To maintain and protect the safety/security of our products, services and websites, to prevent and identify safety/security risks, fraud and other criminal activities as well as activities intending to cause harm.

2.5 To comply with statutory requirements (e.g. under tax and commercial law)

2.6 To settle legal disputes, to assert existing contracts and to establish, exercise and defend legal claims

  1. Legal basis

The processing of personal data has its legal basis in the General Data Protection Regulation (GDPR) Article 6 (1) points b, c and f.

Some of the above-mentioned data are needed for the handling of business/enquiries, while others need to be collected as a mandatory requirement. Unless these data are provided, it may not be possible for us to proceed in our business relationship. Please be aware, however, that we would not be liable for contractual nonfulfilment in such a case.

  1. Transfer and disclosure of personal data

A Silgan subsidiary is legally entitled to transfer personal data to other companies within the group where necessary. However, this is only the case if there is an administrative interest in such data exchange (legal basis: GDPR Article 6 (1) point f).

Furthermore, Silgan Metal Packaging transfers personal data to courts of law, authorities, solicitors and other business partners (e.g. shipping and forwarding agents carrying out and handling orders / purchase orders).

Also, Silgan Metal Packaging uses processors for the management of personal data. Such processors are under a contractual commitment to observe GDPR. In such cases processing has its legal basis in GDPR Article 6 (1) point f, as the relevant systems allow central, cross-locational access to specific data, and the data continue to be available in the event of system failure. A range of effective data security precautions have been taken in your interest.

The specified recipients may be located in countries outside the European Union (“third countries”) where laws are in place that do not offer the same level of data protection as in your own country. If this is the case, we follow the legal specifications that data may only be transferred if an adequacy decision has been taken by the European Commission, if adequate guarantees have been agreed with the recipient (e.g. EU standard contractual clauses), if the recipient takes part in a licensed certification system, if binding internal data privacy regulations are in place as stipulated in Article 47 of the General Data Protection Regulation or if an exemption is applicable as detailed in GDPR Article 49 (for instance, because you expressly consented to the proposed data transfer, after you were advised of the possible risks that may be involved for you in such a data transfer in cases where no adequacy decision is available and where there are no suitable guarantees). Feel free to request a copy of the security policy from the contact person specified in clause 11, in accordance with GDPR Article 46, 47 or 49 (1.2) .

  1. Storage periods

Unless a retention period has been expressly specified when collecting your personal data, they will be erased when they are no longer needed for the fulfilment of their purpose and if there are no statutory retention duties (e.g. under tax law or commercial law), unless erasure is prohibited due to ongoing legal claims. Another criterion for the retention of data may be the period of limitation applicable to legal claims (which may be up to 40 years in Austria, depending on the legal basis).

  1. Data retention

If there is no legitimate purpose for the further retention of personal data, they are either erased or anonymised. If this is not possible (e.g. on backup media), the relevant personal data are securely stored and are no longer accessible for processing.

  1. Rights

Please be aware that you have a right of access, rectification, erasure and restriction of your personal data as well as a right to object and a right to data portability.

» According to GDPR Article 15, you are entitled to demand confirmation whether your personal data are being processed by the controller, and you also have a right of access to those data.

» According to GDPR Article 16, you are entitled to demand the immediate rectification of any inaccurate data held about you and/or the completion of incomplete personal data.

» According to GDPR Article 17 you are entitled to demand the erasure of your personal data.

» According to GDPR Article 18 you are entitled to the restriction of processing.

» According to GDPR Article 20 you are entitled to data portability.

» According to GDPR Article 21 you are entitled to object to data processing. If you object to direct marketing, there will be no balancing of interests.

  1. Protection of your personal data

The privacy of your personal details is of special concern to us. To protect your personal data from abuse, loss, unauthorised access and modification, we take, among other things, the following precautions, which are continually modified to bring them into line with the latest technical and organisational equipment:

8.1 All systems are secured against failure according to the state of the art.

8.2 All systems are subject to a backup and restore process.

8.3 Physical security precautions are taken to prevent unauthorised access to the infrastructure where personal data are stored.

8.4 Firewalls, virus scanners, security updates and access logging are employed to protect the network.

8.5 An authorisation policy and a password policy are in place to protect systems against unauthorised access.
